You may be familiar with a homes association and you may think about that as money that you pay to handle your trash or if you have a community pool or if there is snow removal or other lawn service. But the main function of the homes association. It s created by the developer who originally planned out your community. The main purpose for it is to police those restrictions on the land so.
When you buy property you should receive some states. It s an abstract of title in other places..
It s a commitment for title insurance or called a title report. You always get this when you have a loan that you re you re borrowing money to buy the property. But you should request it any time you are buying real estate. Whether or not it is being paid for by a loan because this report is going to show liens and encumbrances against the property.
I have another video specifically on title insurance. But here i want to talk about the covenants and restrictions. So the place that you re going to learn about these is going to be sometimes. It s on the listing agreement or the disclosures.
If your state requires disclosures and residential real estate transactions otherwise. It s going to be on the title work because it s recorded covenants and just restrictions have to be recorded in the official office..
Where the real estate records are where you live and these are going to be referenced by title and the date of the document. You are not going to automatically get a copy of that document. But you need to get a copy of it which you can get from that office and order a copy or contact. The holmes association board.
And they should a lot of them have them online. Now that document you need to read because it s going to tell you what you can and cannot do with your property in addition to what your local state city or township or county says you can or can t do those are usually zoning rules and they re set back lines for building and things of that nature. However. The holmes association are going to be more restrictive.
The reason for the covenants is to have the property maintain its character throughout its its life. You want the neighborhood and the area to maintain its value so they put certain material restrictions and certain space restrictions and also things like whether or not you can have an outbuilding whether or not you can build all the way to the property line or in some cases..
Whether you can affect the front facade of the property. If you can add fencing or other barriers or other ornamental things so you don t want to be disappointed you want to be able to do with your property. What you have in mind. So you need to look at these restrictions to see if it s going to fit with what you want and people blow by this a lot and they really shouldn t because those homes associations can enforce those restrictions on the property that those restrictions run with the land.
And there are methods for the homes association to change those. But it s usually a very cumbersome process you can t count on that happening so you need to abide by the rules and regulations on your property and know about it before you go into that transaction so that you re not disappointed because this is not going to be something that you can use to get out of the contract for sale because you are on what s called constructive notice of these restrictions because they are filed in the local registry for those records and you are supposed to know that that s where those types of records are recorded and you are supposed to go and find out what they say so i hope this was helpful to you if you have any questions about this leave them below.
